| Sumario: | International social law is often perceived as technocratic matter that only experts in social administration and the administration of justice have to deal with. On the contrary, the present legal-historical study shows that coordinating social law expresses the affiliation of people to a ruling association. By answering the question of the political functionality of the nationalization and transnationalization of social rights, it becomes clear that belonging is constructed through sovereign and economic rationales. The latter often act as door openers for a national welfare state. Beginning with legal and socio-philosophical concepts of the assignment of individuals to ruling associations, the work analyzes the legal history of the exclusion and inclusion of Polish workers in German social security from the end of the German Empire to the end of the Second World War using archival sources. Finally, the knowledge gained will be used for the debate on social human rights. |
